  1. We and you

In these conditions we like to write in the form of you to stay personal and close to you. We believe in transparent, clear and honest communication. When we write about ‘you’, ‘you’ or ‘your’, we mean you as a user of our online services. This can be our online application, our apps and/or the visit to our website.

When we write about ‘we’, ‘we’, ‘us’ or ‘our’, we mean Bicockpit BV, trading under the name Bicockpit or Bicockpit.com, located at Regus Queens Tower Delflandlaan 1, 1062 EA Amsterdam, the Netherlands registered with the Chamber of Commerce of Commerce under number 87849178, VAT number: NL864425296B01

2. Validity of these Terms

These conditions apply because you use our services or because you visit our website. If you create a user account with us, you explicitly indicate that you agree to these terms and conditions. We work in all cases on the basis of these terms and conditions and only deviate from them if this has been explicitly agreed to in writing or by e-mail.

General terms and conditions that you may use yourself are expressly not applicable and the validity thereof is expressly rejected by us.

3. Create a user account

If you create a user account with us, you will have to enter a number of details. We need this information to set up your environment. You can supplement and/or adjust your company information afterwards if it changes. You are responsible for the correctness of this information.

4. Monthly period in a user account

Your monthly period is out of sync with the calendar months. The period depends on the date of registration. If you signed up on the 14th of the month, each monthly period will run from the 14th day of the month to the 13th day of the following month.

5. Trial period

The first month, after you have created a user account, you can try Bicockpit.com for free (with the exception of optionally paid services). During this period you can evaluate whether we meet your wishes and your company. If not, you can delete your user account at any time and stop using it.

6. Fair-use policy

A fair use policy applies during the trial period. If you use our service more than we can reasonably expect from a normal user, we can act on this by blocking your account. It is possible that the fair use policy changes. We are not obliged to inform you of this.

7. Stop Bicockpit

You can easily stop using Bicockpit in your user account.

7.1 Delete All Data

Do you want to delete all your data yourself? Then you can indicate this in your user account. Just make sure to export all your data to another place before deleting your user account. We will immediately destroy your user account and all associated data. It is not possible to restore this at a later time.

8. Price changes

We may change our prices in the future. If we do this, we will notify you of the change at least four weeks in advance via our website or by email. If you do not agree with the change, you can delete your user account. If you continue to use Bicockpit.com after those four weeks, you indicate that you agree with the change.

It may also happen that we adjust our prices every year based on the inflation adjustment. We will also notify you at least four weeks in advance and you can also delete your user account if you do not agree with this.

9. What can you expect from us

We especially hope that Bicockpit.com works well for you and that it ensures that you enjoy your administration more and above all; that you have more time for fun things. We therefore do our best to ensure that Bicockpit always works as well as possible. We work hard every day and with great pleasure on Bicockpit to make it better and better.

9.1 Availability

Unfortunately, we cannot guarantee that we are available or accessible 24 hours a day and that we will work without interruptions. We also cannot guarantee that we can be used on every device. We will of course do our utmost to keep Bicockpit.com available and accessible as much as possible.

9.2 Maintenance

We may sometimes take Bicockpit.com offline to carry out maintenance and make adjustments. We try to carry out most maintenance without you noticing anything, but if Bicockpit.com has to be offline, we try to do this as much as possible at night or during the weekend.

9.3 Features

We are free to adjust, add or remove functionalities and parts of Bicockpit.com. It is possible that certain functionalities are no longer available or that Bicockpit.com no longer works on certain devices.

9.4 Information and Reports

We will do our utmost to ensure that all information is current, accurate and error-free, but we cannot guarantee this. It is possible that reports, overviews, invoices or calculations that you make on Bicockpit.com contain errors. This can happen due to a system error on our part, but also because you have entered incorrect information or data yourself. Therefore, always check the reports, overviews and calculations before you use them for, for example, the tax return.

9.5 Helpdesk support

Our support helpdesk is ready to help you with your questions about Bicockpit.com. You can also find questions and answers on our website to help you. All information on our website and answers from our support helpdesk are intended to help you, but do not have the same substantive value as the advice of an accountant or bookkeeper. You can therefore not derive any rights from advice from our helpdesk.

9.6 API links

If you use a link to another package, such as an accounting link or bank link, then we only have influence on the API on our side of the link. We have no influence on the systems on the accounting package or bank side. If a malfunction occurs there, we are not responsible or liable for it. If you use our API, we can only influence the operation of the API itself, but we have no influence on the application that communicates with our API. If a malfunction occurs there, we are not responsible or liable for it.

9.7 External Information

We are in no way liable for the availability or the content of internet pages outside our control to which we refer on our own website.

10. Ownership of the data you enter with us

All the data that you enter with us in your user account is of course yours and will always remain yours. We will never and can never claim ownership of this data.

11. Relationships with other companies

Please note that we are a different and independent company than any other companies we integrate, you should not confuse us.

12. Personal data of you and your customers

In Bicockpit.com you can enter personal data of others, such as address details and contact details of your contacts or creditors. We use this information, for example, on the documents you create via our system. Because you share this personal data with us, we and you must comply with the General Data Protection Regulation (GDPR). To comply with the GDPR, we agree to the following:

From a legal point of view, you are responsible for processing the personal data you enter with us. Then you are the controller. We are the processor in this. According to the GDPR, it is necessary that we conclude a processing agreement with each other. Based on this processing agreement, we will only process the personal data you enter with us if you instruct us to do so. You give us this assignment by agreeing to these terms and conditions.

Therefore, read our processing agreement carefully.

You are responsible for the personal data you enter in your user account. You must comply with the applicable legislation and legal requirements. If you do not comply with these requirements and we are held liable by a third party for any damage incurred, you will immediately indemnify us and release us from any liability.

To protect the aforementioned personal data, we have taken all measures within our power, such as secure SSL encryption of data traffic, encryption of personal data with AES-256. Employees all use a security key to access the servers and administration. Our servers are located on Dutch territory and are subject to Dutch law.

We and you ensure that anyone who has access to the aforementioned personal data will not share it with others and will keep it secret. Unless we are obliged to do so by a legal regulation.

13. Your privacy

Privacy is an important right, and we are also strong supporters of privacy. We will always do our best to comply with the General Data Protection Regulation (GDPR). We also take steps to protect your personal information. Read more about this in our privacy statement.

14. Your responsibilities

There are some rules for using Bicockpit.com

– You may not automatically create a user account;
– You must meet the minimum legal age.
– A user account may be used by one company. If you have multiple trade names, you are allowed to use one user account, you can then define multiple profiles in your user account.

Bicockpit.com is used by many entrepreneurs and we are therefore proud of the trust that is placed in us. On the other hand, we also trust that you use Bicockpit.com in a responsible manner.

You agree that you will not misuse Bicockpit.com or help anyone else to do so. This includes that you may not do anything contrary to these terms and conditions, legal provisions, public order or good morals (applicable norms and values). This means that you include:

– The vulnerability of Bicockpit.com may not probe, scan or test without prior written permission;

– not crack or otherwise circumvent security and authentication measures;

– do not send unwanted advertising, promotions, advertisements and spam via Bicockpit.com;

– not send altered or misleading information or information with a false source of identification, including ‘spoofing’ and ‘phishing’;

– not incite intolerance or hatred against any person or group on the basis of race, religion, ethnic origin, sex, gender identity, sexual orientation, disability or limitation;

– violate the law in any way, including by storing, publishing, or sharing material that is fraudulent, defamatory, or misleading;

– infringe on the privacy or rights of others.

We reserve the right to block or delete your user account if we have substantial suspicions that you are using Bicockpit.com for unauthorized applications as described above.

You may not reproduce information, images and/or other materials from us on other websites or media without our permission. Full or partial copying of Bicockpit.com is also not allowed.

You are responsible for the correctness of the e-mails and documents sent under your name and you are responsible for any claims arising from incorrect billing, incorrect delivery, tax claims, etc.

You are responsible for the use of our service and the actions that take place in your user account. This also means that you are responsible for misuse of your user account. We are explicitly not responsible for this. We therefore recommend that you choose a good and strong password and change it on a regular basis. Do not share your password with others. Do you want to give other people, such as an accountant or partner, access to your user account? Then create an extra user and give them access to your administration.

15. Breach of Terms

If you take actions that are contrary to our terms and conditions, you are fully liable for any damage caused as a result. If someone else holds us accountable for damage caused by you violating our terms and conditions, you immediately indemnify us against that damage. We can block your user account or permanently delete your user account with or without warning. This can also be done at the request of an authority. It is also possible that we give an authority access to your user account if we are legally obliged to do so. If we delete your user account and all associated data, you will lose all your information. We are not responsible or liable for any damage you suffer as a result.

16. Dispute resolution

Let’s first discuss your dispute together and try to work it out without the need for formal legal proceedings. We would like to hear from you if you are not satisfied with us. If we cannot come to an agreement together, we will submit the dispute between us to a competent Dutch court in the district where we are located. Dutch law applies to this agreement.

17. How do we deal with force majeure?

If there is a case of force majeure that prevents us from offering our services, we are not obliged to offer Bicockpit.com or to comply with our other obligations under this agreement. This also includes force majeure that has arisen because our suppliers have not fulfilled their obligations or because there was a malfunction in the power or internet facilities at us, at one of our suppliers or at others.

18. For what damage can you hold us liable?

If you wish to hold us liable for any damage, you can do so by sending us a written notice in the form of a notice of default. In this notice of default you write down why and for what you hold us liable. You must give us a reasonable period of time in which we can look for a solution for you. This may consist of repairing or limiting any damage. The liability of Bicockpit.com for indirect damage, including consequential damage, missed savings, lost profit and damage due to business interruption, is explicitly excluded.

The liability of Bicockpit.com due to attributable shortcomings in the fulfillment of the agreement is in all cases limited to compensation for direct damage, exclusively as a result of insufficient availability. However, in no case will the total compensation for direct damage exceed € 500 (five hundred euros).

19. Changes to these terms and conditions

These terms and conditions can sometimes change. We will let you know in good time by e-mail or via our website. If you do not agree with the change, you can cancel our agreement by deleting your user account. If you continue to use Bicockpit.com after receiving notification of the new general terms and conditions, we will assume that you agree with the new general terms and conditions.
